Reklamo ni Happy vs Aiko, ibinasura


Sa pamamagitan ng isang common friend, inamin ni Cristina Decena na nagkasama sila ni Rey Malonzo sa Hong Kong ilang araw na ang nakararaan.

Business trip daw ang dahilan ng pagpunta nila sa Hong Kong kaya hindi ito dapat bigyan ng malisya o ibang kahulugan.

Aware ang dating girlfriend ni Phillip Salvador na nali-link sila sa isa’t isa ng dating alkalde ng Kalookan City.

Tinatawanan lang ni Cristina ang balita dahil purely business ang relasyon nila ni Rey.

In fact, magiging ninang siya sa nalalapit na kasal ng anak nina Rey at Gigi Malonzo.

Ang common friend din ang nagsabi sa amin na pinagtatawanan lang ng asawa ni Rey ang balita tungkol sa kanila ni Cristina.

Dumating noong Biyernes ang mga American promoter ni Manny Pacquiao para dalawin ito.

Nag-alala ang mga promoter sa balita na naka-confine sa ospital si Manny kaya tiniyak nila na maayos na ang kalagayan ng sikat na Filipino boxer na muling magkakaroon ng laban sa July at gaganapin dito sa ating bansa.

Iba-iba ang version na narinig namin tungkol sa hospital confinement ni Manny. May nagsasabi na simpleng general check-up ang ginawa sa kanya at ayon sa iba, nagkaroon siya ng gastroenteritis.

Nalaman ng kampo ni Joanna Bacosa na naka-confine si Manny sa ospital.

Reportedly, sinubukan ng legal counsel ni Joanna na puntahan si Manny sa ospital para sumailalim ito sa DNA test pero hindi sila nag-abot dahil nag-check out na raw ang boxer.

Nag-volunteer ang lawyer ni Joanna na sadyain si Manny sa ospital dahil sinabi noon ng boxer na wala itong time para sa DNA test.

Nagbakasakali ang abogado ni Joanna na may panahon na si Manny sa DNA test dahil nasa ospital lamang siya.

Si Joanna ang babae na lumantad kamakailan at nagsabi na may anak sila ni Manny. P15M umano ang halaga ng pera na hinihingi ni Joanna mula sa kanyang ex-lover boxer.

Hindi raw natuwa si Madonna Happy Ongpauco sa desisyon ng Makati City Prosecution Office na i-dismiss ang mga kaso ng Slander, Oral Defamation at Perjury na isinampa niya laban kay Aiko Melendez noong October 2005.

May nagpadala sa amin ng resolution na nilagdaan ni Makati City 3rd Assistant City Prosecutor Josefa D. Laurente:

"Respondent Aiko Melendez is being charged with five (5) counts of Slander/Oral Defamation for allegedly uttering defamatory remarks against Madonna Happy Ongpauco-Rivera during an interview in several talk shows aired on national television, particularly on the following dates:

October 09, 2005 The Buzz

October 08, 2005 Entertainment Konek

October 08, 2005 Startalk

October 09, 2005 S-Files

Wherein Aiko allegedly made it appear that Happy is a liar, a person who calls people names and one who belittles actresses.

"Happy narrated the incident that happened on October 2, 2005 at Novu Restaurant, Makati City, where she and her friends had an altercation with the group of Aiko.

"After the incident at Novu Restaurant, Aiko appeared on various television talkshows, explained her side of the story and claimed that Happy and her friends allegedly called her nasty words such as, ‘loser,’ ‘pokpok’ and ‘addict’.

"Respondent Aiko Melendez is also being charged with perjury for allegedly making willful and deliberate assertions of falsehood in her Complaint-Affidavit for Grave Oral defamation, Intriguing Against Honor and Unjust Vexation against complainant Happy and her friends.

"In the Affidavit of Aiko, she stated that Happy called her a ‘slut’, ‘addict’ and ‘pokpok’ during Novu episode, when the truth is, according to Happy, she never made those remarks against Aiko.

"For her part, respondent Aiko believed that she has not slandered or defamed complainant in her interviews on television.

"She insisted that the statements she made were all true. What she narrated were only factual accounts of what actually transpired during the incident at Novu.

"She made the statement without malice. Neither was she motivated by any grudge, ill feelings or spite against complainant.

"There was no intention to injure the reputation of the complainant. She only agreed to the interviews to clear her name and protect her reputation as a public figure and an actress.

"Aiko also believes that she has not made false allegations in her Complaint-Affidavit against complainant and her friends.

"She argued that what she stated in her affidavit were the truth of what happened at Novu Restaurant.

"Complainant filed a reply quoting verbatim the alleged defamatory statements uttered by Aiko during the interview on the various television shows; while respondent Aiko discussed in length in her Rejoinder why there should be no probable cause against her for the crimes imputed by complainant.

"The issue to be resolved in this case is whether or not from the evidence adduced on record there is sufficient ground to believe that respondent committed the offenses complained of.

"From the facts related by the complainant, this Office finds no statements/ utterances made by respondent in the television shows mentioned as libelous or defamatory in character.

"Complainant quoted verbatim the statements made by Aiko during her interview on October 2, 2005 at the television program The Buzz.

"The statements of Aiko during the said interview are more of narration of what happened between her and the group of complainant at Novu Restaurant.

"There was nothing in Aiko’s statements that would tend to destroy the reputation, good image or cause the dishonor of complainant at Novu Restaurant.

"Neither was there any defamatory statement made by Aiko on October 9, 2005 interview at the same tv program The Buzz. It is true that Aiko made the following remarks ‘napakasinungaling na naman ng dating nila.’

"The aforesaid remarks of Aiko may be taken to mean as accusing complainant a liar, if said statement is interpreted independently or separately from Aiko’s other statements.

It should be emphasized that Aiko explained in her succeeding statements why she said that the group of complainants were distorting the true facts of what transpired at Novu Restaurant.

"Even the statement ‘Porket mga anak mayaman kayo, ang tingin n’yo sa artista, napakababa’ which Aiko uttered in the television show Entertainment Konek cannot be considered defamatory.

"Aiko was merely expressing how she felt towards the group of complainant, who were allegedly laughing sarcastically at her. It was more of an expression of an opinion. Likewise, we find no libelous statement made by Aiko in her interview at S-Files.

"The charge of perjury can neither prosper at this point in time. The alleged perjurious statements are the allegations of Aiko in her Affidavit-Complaint charging complainant and her friends with Grave Oral Defamation, Intriguing Against Honor and Unjust Vexation.

"Note that the questioned complaint of Aiko is still under preliminary investigation, hence, it is still premature to say that the basis for the complaint is grounded on false facts.

"WHEREFORE, in the light of the forgoing, it is respectfully recommended that the instant complaint be dismissed."
