Senado umaasa pa ng himala sa SC

Tanging himala ang nakikitang pag-asa ng Senado para mabago ng Korte Suprema ang 9-6 decision na pumabor sa executive privilege na iginiit ni Commission on Higher Education (CHED) chairman Romulo Neri sa broadband scandal probe.

Ayon kay Senate minority floor leader Aquilino “Nene” Pimentel Jr., suntok sa buwan kung tatanggapin ng siyam na mahistrado ng Korte Suprema na nagkamali sila ng desisyon at papayag na baliktarin ang 9-6 votes.

“Is it possible that we can change the minds of the justices? I would say it is difficult. But it is not impossible. It may be improbable, but not necessa­rily impossible. If the facts are laid clear to them that the majority conclusion are erroneous. And that is what the motion for reconsideration will attempt to do,” ani Pimentel.

Isang ‘grave mistake’ ang ginawa ng siyam na mahistrado, ayon pa kay Pimentel, kung kaya’t malaking palaisipan kung paano babaguhin ng mga ito ang naibabang desisyon lalo pa’t mismong punong mahistrado, sa katauhan ni Chief Justice Reynato Puno ang kontra sa nanaig na desisyon.

Bagamat suntok sa buwan na mabago pa ang 9-6 decision, naniniwala pa rin si Pimentel sa isang ‘himala’.

“The filing of a motion for reconsideration is not only prudent. I think it is necessary for purposes of historical records. I think it is important that majo­rity of the justices, nine of them, will have to be confronted with the facts as we see them,” ani Pimentel.

Ayon kay Pimentel, anuman ang kahihinatnan ng motion for reconsi­deration sa Korte Suprema, hindi susuko ang Senado at tuloy ang kanilang laban para sa katotohanan.

“Whether we succeed or not, the important things is, for the purposes of records, the Senate will be seen as fighting to the very end in the assertion of our powers and duties, rather than gi­ving way to this erroneous decision which says that the private rights of Neri can trump the po­wers of the Senate as defined in the Constitution,” ani Pimentel.
